BY MAKING A BOOKING WITH US YOU CONFIRM YOUR ACCEPTANCE OF THESE CONDITIONS

 

1. OUR SERVICES AND OBLIGATIONS

1.1 Down Under Endeavours, is an Official Sub-Agent of House of Travel Rugby (HOTR). HOTR is a division of House of Travel Christchurch City Limited and House of Travel Holdings Limited (“we”) have been appointed an Official Travel Sub-Agent for Rugby World Cup 2011 (“RWC”). We supply travel agency services consisting of arranging, booking, and coordinating travel facilities and services. The actual services and products are provided, supplied or performed by suppliers of travel, entertainment, and accommodation facilities or services (“Suppliers”).

1.2 We undertake to perform our travel agency services described in Clause 1.1 above (“the Services”) with reasonable care and skill. We will not however be liable for any loss or damage that results from the act, default or omissions of any person other than our employees, agents, or ourselves or any cause independent of human control. This includes (but is not limited to) loss, or damage which arises directly or indirectly from act of God, weather disruptions, dangers incidental to the sea or air, fire, breakdown in machinery or equipment, acts of Governments or other authorities de jure or de facto, wars whether declared or not, hostilities, civil disturbances, strikes, riots, deaths, acts of terrorism, pilferage, pandemics, quarantines or medical or customs regulations.

1.3 We will endeavor to provide the most suitable travel arrangements to meet the particular requirements you make known to use. However, travel is an individual experience, and your preferences and opinions may vary from our own. For this reason, we cannot take responsibility for your individual satisfaction.

2. SUPPLY OF TRAVEL, ENTERTAINMENT AND ACCOMMODATION, SERVICES AND FACILITIES BY SUPPLIERS

2.1 When we make bookings with Suppliers, we are acting as a booking agent for such Supplier and make no representation regarding the quality of their services.

2.2 All travel, entertainment, and accommodation facilities or services are supplied directly to you by the Suppliers. We have no control over the Suppliers themselves, or the manner in which they provide their services and products Accordingly:

2.3 We will not be liable for any loss or damage of any kind that may arise from your use or consumption of, or inability to use or consume facilities, products, or services provided by a Supplier.

2.4 The provision by Suppliers of their facilities or services is subject to the terms and conditions of your contract with each Supplier. This includes, without limitation, any terms and conditions imposed by the person organizing or providing tickets to RWC2011.

2.5 Where for any reason, a Supplier is unable to provide particular facilities or services, then that Supplier may be entitled, under its contract with you, to substitute those services or facilities with comparable or equivalent facilities or services without incurring any liability to you. We will endeavor to provide full terms of such contracts if required by you.

2.6 All facilities or services described by us are subject to availability from the Supplier.

2.7 We will not be liable or responsible for any loss or damage relating to your baggage, personal processions, health or welfare, or delays or travel disruptions unless these arise directly from our provision of the Services.

3. MATCH TICKETS AND SEATING

3.1 All tickets to matches forming part of RWC2011 (“Match Tickets”) are non refundable and non transferable.

3.2 When booking your Match Tickets you must provide your Name and Passport Number.

3.3 Match Tickets are sold on the Ticket Terms and Conditions attached hereto and which you must agree to be bound by.

3.4 You may be required to confirm your identity by showing your passport or other proof of identity to secure entry to matches at RWC2011 (“Matches”).

3.5 Match ticket category allocations will not be advised to Official Travel Agents until at least June or July 2010.

3.6 Package prices are currently based on category C match tickets.

3.7 Down Under Endeavours reserves the right to amend our current package pricing costs, subject to confirmation of our final match ticket category allocations.

4. TICKETS LIMITED IN NUMBER

4.1 Match Tickets are limited in number and we make no warranty as to their availability until the deposit is paid to confirm tickets.

5. RETURN TRAVEL JOURNEYS

5.1 When booking your Match Ticket you must also book a return travel journey to and from the Matches (“Travel Package”).

6. PAYMENTS

6.1 A deposit is required and must be paid at the time of booking. This deposit is non-refundable and nontransferable.

6.2 The final payment must be paid by 1 November 2010.

6.3 Failure to pay these installments on time may result in cancellation of your Travel Package and/or the Other Services to be purchased at our discretion.

6.4 Travel documents (including Match Tickets) will not be released until full payment has been received, and in the case of Match Tickets, until we receive the same.

7. CANCELLATION / REFUNDS

7.1 If you wish to cancel your Travel Package for any reason, you must advise us in writing as soon as possible.

7.2 Where you cancel any Travel Package, you will not receive a refund of your deposit. If you have made additional payments, those will be refunded to you less any amounts required to pay for any facilities, products, or services which we have booked on your behalf which are non-refundable.

7.3 Where you breach these Terms and Conditions or the Ticket Terms and Conditions then we shall be entitled to cancel your Travel Package and you shall not be entitled to the refund of any payments made by you.

8. INSURANCE

8.1 You must arrange comprehensive Travel Insurance. You may be required to provide evidence of comprehensive coverage.

8.2 We strongly recommend that you insure yourself fully against cancellation, loss of luggage and personal property, and medical expenses. We are able to provide you with further information and a price quotation should you require.

9. RESERVATION AMENDMENTS
9.1 Once confirmed, Travel Packages cannot be reduced or downgraded; however add-ons and extensions are permitted subject to availability.

10. ITEMS NOT COVERED

10.1 Unless otherwise specified, the costs of flights, meals, drinks, laundry, insurance, sightseeing, local taxes, are not included in the travel cost.

11. BUSINESS PURPOSE

11.1 You agree that where our Services are acquired for business purposes, or where you hold yourself out as acquiring our Services for business purposes, and we will not be liable or responsible for any loss or damage of any kind to you, including an consequential loss or damage however it may be caused.

12. INFORMATION ON TRAVEL PACKAGES

12.1 While we attempt to ensure that the content of our website is correct, accurate, and up to date at the current time, the contents of the website are drawn from information supplied to us by Suppliers. We do not have, and cannot be reasonably expected to have, personal knowledge about all of the facilities of services provided by each Supplier.

12.2 Facilities or services may change. We will endeavor to keep you informed of any changes to information in our website which are brought to our attention.

12.3 Descriptions featured in our website are drawn from information provided by our Suppliers. Any facilities or services shown are subject to change at any time. Please advise if you have any special requirements.

12.4 Accommodation in our website is based on two people sharing a room. Request for specific bedding arrangements must be made at the time of booking but cannot be guaranteed. For example, twin share may consist of single beds or a shared double bed.

13. PRICES

13.1 All prices shown in our website unless specified are expressed in United States Dollars (USD).

13.2 Prices may be subject to variation between the time of booking and the date of departure due to events beyond our control. We reserve the right to vary the price up to the time of your departure and accordingly Travel Package pricing is subject to final confirmation.

14. NON-USE OF SERVICES OR FACILITIES

14.1 If you decide not to use part or parts of the arranged services or facilities, you will not be entitled to a refund from us (provided we carried out our service with reasonable skill and care) and you may not be entitled to a refund from any Supplier.

15. HEALTH OR DISABILITY

15.1 Some Suppliers may reserve the right to refuse to carry or accommodate people who because of a health condition or disability may require services or facilities to be provided in a special manner. You should check with us if this is concern for you.

16. SERVICE SATISFACTION

16.1 If you encounter any situation where the service supplied to you does not meet your satisfaction, please take the matter up with the Supplier immediately. Your contract for each service is with the Supplier. If this is not possible, or if you are still dissatisfied, please contact us. We will endeavor to investigate on your behalf and to negotiate with the Supplier to resolve the matter as soon as possible.

17. LEGAL CLAIMS

17.1 You agree that the laws of the United States of America will govern any claims or legal action in connection with the provision of the Services to you. Any claim or legal action against Suppliers is likely to be subject to the terms of your contract with them, and may be governed by the laws of other countries.

18. PRIVACY ACT WAIVER
18.1 You consent to us providing the following Personal Information to Rugby and Hospitality (NZ) Limited for general security purposes, for the printing of tickets, and the prevention of black market ticket sales: Your names and address and passport number or other form of identity; your travel details; and your contact details.

19. SALES OF TICKETS

19.1 We are only entitled to sell Match Tickets as part of a Travel Package.

20. FORCE MAJEURE

20.1 If by means of any event of force majeure (which shall include terrorism, pandemic or any cause or event outside the control of the parties) we shall be delayed in, or prevented from performing our obligations, then such delay or non performance shall not be deemed a breach or entitle a damage claim. Our obligations shall be suspended whilst such event of force majeure continues.

21. AIRPORT AND MATCH TRANSFERS

21.1 Transfers between Hotel and Match venues will be by Coach, Taxi or Shuttle.

I acknowledge receipt of these Terms and Conditions and the Ticket Terms and Conditions and agree that by purchasing a Travel Package I am bound by these Terms and Conditions and the Ticket Terms and Conditions.
In particular I acknowledge that any breach of the Ticket Terms and Conditions including resale, transfer or commercial use, of the Match Tickets or any attempt to resell, transfer or commercially use any of the Match
Tickets shall result in the cancellation of the Match Tickets and loss of any Travel Package payments I have made.
